This contract discloses about:
Your rights as a user of the Mapfry Platform.
Rights that you grant to MAPFRY when using your Platform.
Rules that everyone must follow when using the Mapfry Platform.
1.1 The Mapfry Platform, the website www.mapfry.com and its services are the property of MAPFRY GEOMARKETING TECNOLOGIA DA INFORMAÇÃO LTDA, CNPJ 39.328.477/0001-36, with headquarters in São Paulo, SP.
1.2 We grant you a limited, personal, non-exclusive, non-transferable and revocable license to use Mapfry in accordance with these Terms and Brazilian law, including the Internet Civil Framework and the General Personal Data Protection Act (LGPD).não integra a oferta da Mapfry.

2.3.1 Você declara que não é sócio, investidor, funcionário, colaborador, associado, prestador de serviços ou representante de qualquer empresa que atue no mesmo segmento de atividade da MAPFRY, ou seja, no desenvolvimento e na distribuição de sistemas de Geomarketing e correlatos.
3.1 A Mapfry é um software de geomarketing oferecido via internet, continuamente atualizado, que disponibiliza recursos para criação de estudos, mapas, áreas de influência, apresentações e compartilhamentos.
3.2 O acesso é oferecido por planos gratuitos e pagos, com funcionalidades e franquias distintas.
4.1 Administrador: usuário autorizado a gerir plano, cobrança, convites, permissões e configurações da conta.
4.2 Conteúdo do Cliente: dados, tabelas, endereços, arquivos, textos, imagens e demais materiais enviados ou criados pelo Cliente na Plataforma.
4.3 Conteúdo Mapfry: software, interface, marcas, metodologias, documentação, dados, camadas e demais conteúdos fornecidos pela Mapfry ou por seus licenciadores.
4.4 Conteúdos de Mercado: dados, indicadores, estimativas, geometrias, pontos de interesse e camadas analíticas disponibilizados como parte do Conteúdo Mapfry.
4.5 Projeto: estrutura criada na Plataforma para organizar análises, mapas, apresentações, publicações e compartilhamentos.
4.6 Plano: conjunto de funcionalidades, limites de uso, usuários, período e preço exibido na página comercial ou no checkout.

Contratar planos, acompanhar consumo de franquias, importar dados, criar camadas e publicar seus projetos.
5.3 Restrições cadastrais, de pagamento ou violação destes Termos podem suspender o acesso a recursos, inclusive aos projetos já criados.
6.1 Plans and features are described at www.mapfry.com/plans.
6.2 Projects can be public, total, or partial.
6.3 Mapfry may modify plans, functionalities, or offers, giving reasonable notice when there is a relevant impact.
7.1 The contracting of plans and resources through the Mapfry platform is for the period or resource franchise, as indicated at the time of purchase.
7.2 For recurring or larger contracts (e.g., annual plans, multiple corporate users or customized integrations), a specific contract must be concluded directly with Mapfry, whose commercial and legal conditions overlap with these Terms of Use.
7.3 Non-payment or non-approval of the transaction may lead to the immediate suspension of access to the plan or resources purchased, until settlement.
7.4 There is no refund after the statutory regret period.
7.5 Changes do not affect contracts already completed, only new acquisitions made after the date of the change.
7.6 The use of multiple accounts or files to circumvent business rules may result in a consolidation of the use and charge equivalent to actual consumption, in addition to appropriate additional measures.
8.1 Deleted projects and content remain in the recycle bin for 30 (thirty) days and are then irreversibly removed.
8.2 The cancellation of a paid plan does not imply the exclusion of projects already created during its term.
8.2.1 In this case, the account will be automatically reverted to the free version, keeping the existing projects, but subject to the limitations of this modality.
9.1 Mapfry is an online technology service. Despite our efforts, failures, slowdowns, or interruptions may occur, including due to external factors such as the internet, providers, or cyberattacks. In these situations, we are not responsible for loss or damage resulting from it.
9.2 The user must have broadband internet, own equipment and a secure environment (antivirus, firewall, etc.), being solely responsible for this.
9.3 Mapfry adopts security measures, but cannot guarantee absolute protection against intrusions. Therefore, we recommend that only essential data be uploaded.
9.4 The contents of the platform are provided “as is”. They are not strategic advice or recommendation and may contain errors or limitations. The user assumes full responsibility for the decisions made based on the studies created.
9.5 Mapfry is not responsible for obligations assumed between users and third parties. If there are disputes, complaints or legal actions between users, they release Mapfry from any liability.
10.1 It is prohibited to:

11.2 The Terms may be amended at any time, with prior notice and publication of the new version. Continued use of the platform after the changes signifies acceptance.
11.3 The Terms are valid indefinitely, as soon as they are accepted upon registration.
11.4 If any clause is considered invalid, the others remain valid, and the clause is revised to comply with the law.
11.5 Any dispute arising from these Terms will be resolved in the District Court of São Paulo - SP, to the exclusion of any other, however privileged, except in cases where the Consumer Protection Code guarantees the jurisdiction of the consumer's domicile.
