This contract discloses about:
Your rights as a user of the Mapfry Platform.
Rights that you grant to MAPFRY when using your Platform.
Rules that everyone must follow when using the Mapfry Platform.
1.1 The Mapfry Platform, the website www.mapfry.com and its services are the property of MAPFRY GEOMARKETING TECNOLOGIA DA INFORMAÇÃO LTDA, CNPJ 39.328.477/0001-36, with headquarters in São Paulo, SP.
1.2 We grant you a limited, personal, non-exclusive, non-transferable and revocable license to use Mapfry in accordance with these Terms and Brazilian law, including the Internet Civil Framework and the General Personal Data Protection Act (LGPD).
1.3 Registration is restricted to people over 18 years of age and who are legally capable.
2.1 By creating an account in the name of a company, you declare that you have sufficient legal powers to represent it.
2.2 Accounts registered with corporate email will be treated as business accounts.
2.2.1 If you are not empowered to represent your Company, create a personal account using a private Email, such as a Gmail account, or contact us to establish a Corporate contract through the appropriate channels.
2.3 Projects with data and analysis of a company must be created and maintained in that company's account.
2.4 Restriction on competitors. You declare that you are not a partner, investor, employee, collaborator, associate, service provider, or representative of any company that operates in the same business segment as MAPFRY, that is, in the development and distribution of Geomarketing and related systems.
3.1 Mapfry is a geomarketing software offered via the internet, which is continuously updated, that provides resources for creating studies, maps, areas of influence, presentations and sharing.
3.2 Access is offered through free and paid plans, with different features and franchises.
Administrator: user with powers to manage plans, payments, invitations, and permissions.
Publisher: user with permission to create, modify, and delete projects.
Viewer: user with permission to view private projects.
Market Content: data and layers provided by Mapfry.
User Content: data, tables, addresses, and files imported by the user.
Projects: organization, presentation, and sharing structures within Mapfry.
5.1 After creating the account, you access the management panel and the project editor, and you can:
Contract plans, monitor franchise consumption, import data, create layers, and publish Stories.
5.2 Registration restrictions, payment restrictions, or violation of these Terms may suspend access to resources, including projects already created.
6.1 Plans and features are described at www.mapfry.com/plans.
6.2 Projects can be public, total, or partial.
6.2.1 Public projects can be copied by other users and accessed via a link.
6.3 Mapfry may modify plans, functionalities, or offers, giving reasonable notice when there is a relevant impact.
7.1 The contracting of plans and resources through the Mapfry platform is for the period or resource franchise, as indicated at the time of purchase.
7.2 For recurring or larger contracts (e.g., annual plans, multiple corporate users or customized integrations), a specific contract must be concluded directly with Mapfry, whose commercial and legal conditions overlap with these Terms of Use.
7.3 Non-payment or non-approval of the transaction may lead to the immediate suspension of access to the plan or resources purchased, until settlement.
7.4 There is no refund after the statutory regret period.
7.4.1 Cancellations after this deadline do not generate a proportional refund, and access is maintained until the end of the contracted period or franchise.
7.5 Mapfry may update the prices and rates of its specific plans at any time.
7.5.1 Changes do not affect contracts already completed, only new acquisitions made after the date of the change.
7.6 The use of multiple accounts or files to circumvent business rules may result in a consolidation of the use and charge equivalent to actual consumption, in addition to appropriate additional measures.
8.1 Deleted projects and content remain in the recycle bin for 30 (thirty) days and are then irreversibly removed.
8.2 The cancellation of a paid plan does not imply the exclusion of projects already created during its term.
8.2.1 In this case, the account will be automatically reverted to the free version, keeping the existing projects, but subject to the limitations of this modality.
9.1 Mapfry is an online technology service. Despite our efforts, failures, slowdowns, or interruptions may occur, including due to external factors such as the internet, providers, or cyberattacks. In these situations, we are not responsible for loss or damage resulting from it.
9.2 The user must have broadband internet, own equipment and a secure environment (antivirus, firewall, etc.), being solely responsible for this.
9.3 Mapfry adopts security measures, but cannot guarantee absolute protection against intrusions. Therefore, we recommend that only essential data be uploaded.
9.4 The contents of the platform are provided “as is”. They are not strategic advice or recommendation and may contain errors or limitations. The user assumes full responsibility for the decisions made based on the studies created.
9.5 Mapfry is not responsible for obligations assumed between users and third parties. If there are disputes, complaints or legal actions between users, they release Mapfry from any liability.
9.6 There is no corporate, labor or commercial relationship between Mapfry and users other than what is established in these Terms. Each party is responsible for its own legal obligations.
10.1 It is prohibited to:
Copy, redistribute, or misuse the content.
Reverse engineer or bypass technical protections.
Sell, rent, or sublicense the system.
Use bots or scrapers to gather information.
Create illegal, offensive, fraudulent, or malicious content.
Interfering with the operation of the platform or exploiting security flaws.
11.1 Mapfry will officially communicate with users by registered e-mail.
11.2 The Terms may be amended at any time, with prior notice and publication of the new version. Continued use of the platform after the changes signifies acceptance.
11.3 The Terms are valid indefinitely, as soon as they are accepted upon registration.
11.4 If any clause is considered invalid, the others remain valid, and the clause is revised to comply with the law.
11.5 Any dispute arising from these Terms will be resolved in the District Court of São Paulo - SP, to the exclusion of any other, however privileged, except in cases where the Consumer Protection Code guarantees the jurisdiction of the consumer's domicile.
